Design – Protecting the look that sets you apart.
Just like trade marks, your designs are valuable assets to your business. Whether it’s the look of a product, a unique pattern, or a distinctive shape, a registered design helps protect your brand’s visual identity and stops others from copying your creations or creating something that looks too similar.
Designs can be anything from two-dimensional patterns (think logos or fabric prints) to three-dimensional objects (like packaging or product shapes). For a design to be registered, it needs to be new and have “individual character” compared to existing designs in the market—it can’t be a simple copy of what’s already out there.
Registering your design gives you exclusive rights to how it looks and makes it much easier to enforce. A design registration can prevent others from making, importing, selling, or using a product with a similar design. Plus, the unique registration number you get when your design is registered can be a deterrent to potential copycats when it’s placed on your packaging.
